dc.description.abstractThe Principles of Transnational Civil Procedure are compatible with jury trial, as in the American common law system, and also with the nonjury trial procedures in other common law systems and in the civil law systems. From a comparative law perspective, it is instructive to consider the procedural virtues of the jury system, which are often ignored, while also considering the off-voiced criticisms of the jury system. These procedural virtues include ones that are "mechanical" but nevertheless important.
