Abstract
The legal safeguards for submarine cables are complex yet insufficient to address intentional damage on the high seas. The enforcement of such violations relies exclusively on flag states who may be unwilling or unable to prosecute wrongdoers, leaving harmed states without proper recourse and posing a major security threat to our global communications infrastructure. The United States must take the lead in modernizing international law to fit the reality of today’s world by not only increasing state practice under existing treaties but also collaborating with allies to establish new agreements designed to tackle these issues.
