Abstract
In 1964, the Immigration and Naturalization Service (INS) ordered the deportation of Clive Michael Boutilier, a Canadian citizen, because he was gay. Boutilier had first entered the United States in 1956, and after 1959 he had lived continuously in the United States as a productive resident. When he applied for citizenship in 1963, Boutilier admit ted in an affidavit that he had been arrested in New York in 1959 on a charge of homosexual sodomy. Although the charge was ultimately dismissed on default of the complainant, Boutilier further admitted in a second affidavit that for five years prior to his initial entry into the United States and for the eight and one-half years after that entry, he had engaged in sexual relations with other men on an average of three or four times per year.
